By downloading, installing, or using WristAI ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

WristAI is a voice-powered AI assistant application for Apple Watch and iPhone. The App allows you to have real-time voice conversations with an AI assistant powered by OpenAI's GPT-4o technology.

3. Eligibility

You must be at least 13 years old to use WristAI. By using the App, you represent that you meet this age requirement. If you are under 18, you should review these Terms with a parent or guardian.

4. Subscriptions and Payments

WristAI offers subscription-based access to its features. By subscribing, you agree to the following:

  • Subscriptions are billed in advance on a monthly or annual basis
  • Free trials may be offered; you will not be charged until the trial period ends
  • Subscriptions automatically renew unless cancelled before the renewal date
  • All payments are processed through Apple's App Store and are subject to Apple's terms
  • Refunds are handled according to Apple's refund policies
  • You can manage or cancel your subscription in your Apple ID settings

5. Usage Limits

To ensure fair usage and service quality, WristAI may impose daily or monthly usage limits on the number of conversations or tokens processed. These limits may vary based on your subscription tier and are subject to change.

6. Acceptable Use

You agree not to use WristAI to:

  • Generate content that is illegal, harmful, threatening, abusive, or harassing
  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Attempt to gain unauthorized access to our systems or services
  • Use the service for any commercial purpose without our consent
  • Circumvent any usage limits or restrictions
  • Reverse engineer, decompile, or attempt to extract the source code

7. AI-Generated Content

WristAI uses artificial intelligence to generate responses. You acknowledge and agree that:

  • AI responses may not always be accurate, complete, or up-to-date
  • You should not rely on AI responses for medical, legal, financial, or other professional advice
  • AI responses do not represent our views or recommendations
  • You are responsible for evaluating and verifying any information provided
  • AI technology has limitations and may produce unexpected or inappropriate content

8. Intellectual Property

WristAI and its original content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express permission.

9. Privacy

Your use of WristAI is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

10. Disclaimer of Warranties

WristAI is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of WristAI.

12. Service Availability

We strive to maintain the availability of WristAI but do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue the service at any time.

13. Third-Party Services

WristAI relies on third-party services, including OpenAI for AI processing and Apple for iCloud sync. Your use of these services is subject to their respective terms and policies. We are not responsible for the availability, accuracy, or policies of third-party services.

14. Termination

We may terminate or suspend your access to WristAI at any time, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting a notice in the App or by email. Your continued use of WristAI after changes take effect constitutes acceptance of the new Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
